U.S. Appellate Court Ruled Against CommScope and Reaffirmed Dali Wireless’ RAN Virtualization Seminal Patent

Dali Wireless, Inc., a worldwide pioneer in digital radio distribution systems and digital predistortion technology received a decision on August 24, 2021, from the United States Court of Appeals for the Federal Circuit (CAFC). The CAFC affirmed most of the rulings made by Judge Barbara M.G. Lynn in the United States District Court for the Northern District of Texas in May 2020 (Case No. 3:16-cv-00477-M), including CommScope’s infringement of and the validity of U.S. Patent No. 9,531,473 (‘473).

Albert Lee, CEO of Dali Wireless stated, “We are thrilled to see that our ‘473 virtualized RAN patent has been affirmed. Dali is a pioneer in next generation wireless technologies, and our patent portfolio builds the foundation of virtualized wireless networks, especially in 5G. With this decision, we can now focus on innovating more disruptive technologies for the future.”

In May 2019 Dali Wireless filed a second patent infringement lawsuit against CommScope in the U.S. District Court for the District of Delaware, alleging infringement of U.S. Patent Number 8,682,338 (Case No. 1:19-cv-00952-MN). In this case, Dali is seeking damages and an injunction to stop the manufacture, sale, and distribution of CommScope’s OneCell® in-building system. This lawsuit is set for trial in March 2022.

Dali’s dedication to innovation has resulted in the company being granted over 500 global patents and pending patent applications. In addition to providing broad coverage on digital predistortion and radio frequency (“RF”) distribution technology, Dali’s patents are critically important to enabling 4G, 5G and virtual Radio Access Network (vRAN) technologies.
